By accessing or using Level's platform and related apps (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
Level provides WhatsApp-based COD verification and related commerce automations that help merchants reduce RTO from fake and low-intent COD orders.
If you accept on behalf of a company, you represent that you have authority to bind that company. "You" means that company and its users.
Depending on your plan and configuration, the Service may include:
You must provide accurate registration information, keep credentials secure, and promptly notify us of unauthorized use. You are responsible for activity under your account and connected stores.
By installing or connecting Level to Shopify or another platform, you authorize us to access store and order data (including historical orders) as described in our Privacy Policy, within the scopes you grant.
You agree not to use the Service to spam or harass, violate law or third-party rights (including WhatsApp / Meta policies), send messages without required consent, attempt unauthorized access, disrupt the Service, reverse engineer the Service except as allowed by law, or resell access without our written consent.
Our Privacy Policy explains how we collect and use information and is incorporated into these Terms.
You are responsible for having a lawful basis to process customer data, obtaining any required consents for WhatsApp or other messaging, providing accurate customer information, honoring opt-outs, and complying with ecommerce-platform and messaging-provider rules.
You acknowledge that Level may sync historical order data to power fraud and risk features, COD verification quality, and analytics.
You grant Level a worldwide, non-exclusive, royalty-free license to use your business name, store name, trademarks, logos, public storefront imagery, and publicly available App Store or review-site feedback to identify you as a Level customer and to promote the Service in case studies, websites, ads, decks, social posts, and similar materials.
We will not present confidential operational data (for example unpublished revenue or RTO figures) as yours without your prior approval. You may opt out of future brand/logo marketing use by emailing [email protected]; we will stop new uses within a reasonable time and will not be required to recall materials already published or printed.
You also grant Level a perpetual, worldwide, royalty-free license to use and incorporate feedback, suggestions, and ideas you provide about the Service without restriction or compensation.
We may offer a free tier with limited included messages. Paid plans are billed as described in-product (typically via Shopify Billing). Prices and inclusions may change with notice. Fees already charged are non-refundable except where required by law or as we decide case by case.
The Service — including software, designs, templates, documentation, and branding — is owned by Level and its licensors. Except for the limited rights granted in these Terms, no IP rights are transferred to you.
You retain ownership of your store content and customer data. You grant Level the rights needed to host, process, transmit, and display that content to operate the Service, including the marketing license in Section 6.
We aim for high availability but do not guarantee uninterrupted Service. Downtime may occur due to maintenance, failures, third-party outages (including Shopify, Meta, or carriers), or events beyond our reasonable control.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
We do not guarantee specific RTO reduction, conversion rates, delivery of every WhatsApp message, or compatibility with every theme, app, or carrier. Results vary by catalog, audience, consent quality, and configuration.
To the maximum extent permitted by law, Level and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill.
Our aggregate liability for all claims relating to the Service will not exceed the amounts you paid to Level for the Service in the twelve (12) months before the claim arose (or, if none, USD $50).
You may stop using the Service and uninstall the app at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, fail to pay fees, misuse messaging channels, or if we discontinue the Service.
Sections that by nature should survive (including licenses already exercised, feedback license, disclaimers, liability limits, and governing law) survive termination.
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to mandatory protections that apply where you live, courts in India have exclusive jurisdiction over disputes arising from these Terms or the Service.
We may modify these Terms by posting an updated version and revising the "Last updated" date. Material changes may also be announced in-product or by email. Continued use after the effective date constitutes acceptance where permitted by law.
